Terms of Use & End User Licence Agreement — ExitBrief

These Terms of Use and End User Licence Agreement (the "Terms") are a legal agreement between you ("you", "your") and Outercircle Pty Ltd (ABN 75 908 776 659 · ACN 679 663 391) ("Outercircle", "we", "us", "our") for your use of the ExitBrief mobile and web application and its content (the "App").

By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Important — please read first

ExitBrief is a plain-English reference tool. It is general information only and is NOT professional advice. Nothing in the App is legal, medical, financial, or DVA-claims advice, and it is not a substitute for advice from a qualified professional or a registered advocate.

ExitBrief is independent. It is not affiliated with, endorsed by, or connected to the Australian Department of Veterans' Affairs (DVA), the Commonwealth Superannuation Corporation (CSC), Defence Housing Australia (DHA), Open Arms, or any government or statutory body. All such names are used for reference and identification only.

Entitlements, rates, forms, and processing times change. Always verify your specific situation directly with DVA, CSC, or a registered ESO advocate before acting.

2. Eligibility

You must be at least 18 years old, or use the App under the supervision of a parent or guardian who agrees to these Terms. You must use the App in compliance with all applicable laws.

3. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use one copy of the App on devices you own or control, for your own personal, non-commercial use. We retain all rights not expressly granted.

4. Things you must not do

You agree not to:

copy, modify, distribute, sell, sublicense, or commercially exploit the App or its content except as allowed by these Terms or by law;
reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by law;
remove or obscure any copyright, trademark, or other proprietary notices;
use the App to break the law, infringe others' rights, or transmit harmful code; or
misuse the Ask AI feature, including attempting to extract another person's data or to generate unlawful content.

5. Subscriptions, billing, and auto-renewal

The App's core reference content is free. Some features (for example, expanded Ask AI usage) require a paid subscription:

Prices are shown in the App and may vary by region or change over time. The price displayed at purchase applies to that purchase.

Billing is handled by the app store, not by us. Subscriptions are sold and processed through the Apple App Store or Google Play ("the Store"):

Payment is charged to your Store account at confirmation of purchase.
Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
Your Store account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription anytime in your Store account settings (Apple: Settings → [your name] → Subscriptions; Google: Play Store → Subscriptions). Cancelling stops the next renewal; it does not retroactively refund the current period.
If we change subscription pricing, the change will not take effect until your next renewal, and the Store will seek your consent where required.

Refunds are handled by the Store under its policies. Nothing in this section limits any non-excludable rights you have under the Australian Consumer Law (see section 9).

6. The Ask AI feature

Ask AI uses an automated AI language model (Anthropic's Claude) to answer questions.

AI answers can be wrong, incomplete, or out of date. They are not advice and must not be relied on for decisions about your entitlements, health, finances, or claims.
Always verify AI answers against official DVA sources or a registered advocate.
Do not enter sensitive personal information into Ask AI. See the Privacy Policy for how your questions are processed.
We are not responsible for actions you take based on AI-generated content.

7. Intellectual property

The App, its design, the "ExitBrief" name and logo, and all content (other than third-party material and your own data) are owned by or licensed to Outercircle Pty Ltd and are protected by copyright and trademark law. ExitBrief™ is a trademark of Outercircle Pty Ltd. You receive no rights in our trademarks or content except the limited licence in section 3.

8. Third-party content and links

The App references third-party organisations, phone numbers, and websites (for example, DVA, Open Arms, Lifeline). We provide these for convenience and do not control or take responsibility for third-party services, their availability, or their content.

9. Your rights under the Australian Consumer Law

Our App comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that the law says cannot be excluded.

10. Disclaimers and limitation of liability

Except for the rights in section 9, and to the maximum extent permitted by law:

The App and its content are provided "as is" and "as available", without warranties of any kind, including accuracy, completeness, fitness for a particular purpose, or uninterrupted availability.
We are not liable for any loss or damage arising from your reliance on the App's content or AI answers, from errors or omissions, or from any decision you make about your entitlements, health, finances, or claims.
Where our liability cannot be excluded but can be limited, our total liability is limited, at our option, to resupplying the App or services, or to the amount you paid us (if any) for the App in the 12 months before the claim.

11. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses, and costs arising from your misuse of the App or your breach of these Terms, except to the extent caused by us.

12. Suspension and termination

We may suspend or stop providing the App, or terminate your licence, if you materially breach these Terms. You may stop using the App at any time by uninstalling it. Subscriptions are cancelled through your Store account as described in section 5. Sections that by their nature should survive termination (including 7, 9, 10, 11, and 13) survive.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia, without affecting any rights you have under the Australian Consumer Law.

14. Apple App Store — additional terms

If you obtained the App from the Apple App Store, the following also applies:

These Terms are between you and Outercircle only, not Apple. Apple is not responsible for the App or its content.
The licence in section 3 is limited to use on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms (the "Usage Rules").
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims are our responsibility, not Apple's.
Apple is not responsible for addressing any product liability, legal/regulatory, or third-party intellectual property claims relating to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you obtained the App from Google Play, the Google Play Terms of Service also apply to your acquisition of the App.

15. Changes to these Terms

We may update these Terms. We will update the "Last updated" date above and, for material changes, note it in the App's release notes. Continued use of the App after a change means you accept the updated Terms.
